Psychotherapy Notes. HIPAA provides heightened protections for certain records known as “Psychotherapy Notes.” Psychotherapy Notes are notes recorded by a mental health professional documenting or analyzing the contents of conversation during private counseling sessions and that are kept separate from the rest of the medical record. Excluded from this definition are: (a) medication prescription and monitoring; (b) counseling session start and stop times; (c) modalities and frequencies of treatment; (d) results of clinical tests; and (e) summaries of diagnosis, functional status, treatment plan, symptoms, prognosis, and progress. Except as permitted by HIPAA, Psychotherapy Notes may not be released to a third party without a separate, specific authorization signed by the patient.
Right to an Accounting of Disclosures. You have the right to receive an accounting of certain disclosures of your protected dental information made by the provider or its business associates during the six (6) years prior to the date of your request. An accounting is not required for disclosures: (a) for treatment, payment, or health care operations; (b) to you or your personal representative; (c) for persons involved in your care or payment for care; (d) pursuant to an authorization; (e) of a limited data set; (f) for national security or intelligence purposes; (g) to correctional institutions or law enforcement officials in certain circumstances; or (h) incident to otherwise permitted or required uses or disclosures.
